This Privacy Policy describes how My Shift Pro Pty Ltd ("the Company", "We", "Us" or "Our") collects, uses and discloses Your information when You use the My Shift Pro mobile application (the "Application" or "Service"), and tells You about Your privacy rights and how the law protects You.

We use Your personal data to provide and improve the Service. By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy.

Interpretation and Definitions

The following definitions have the same meaning whether they appear in singular or plural.

• Account means a unique account created for You to access the Service.
• Application means the software program provided by the Company, named My Shift Pro, downloaded by You on any electronic device.
• Company refers to My Shift Pro Pty Ltd, PO Box 120, Wentworthville, NSW 2145, Australia.
• Country refers to New South Wales, Australia.
• Device means any device that can access the Service, such as a mobile phone or tablet.
• Employer means the organisation that uses My Shift Pro to assign and manage Your shifts.
• Personal Data is any information that relates to an identified or identifiable individual.
• Service Provider means any person or company that processes data on behalf of the Company.
• Usage Data means data collected automatically through use of the Service.
• You means the individual using the Service.

Types of Data Collected

Personal Data

While using the Service, We may ask You to provide personally identifiable information, including:

• Email address
• First name and last name
• Phone number
• Address, State, Province, ZIP/Postal code, City
• Profile photo (optional)

Location Data

The Application collects precise location data (GPS) from Your Device to provide shift attendance and geofencing features to Your Employer.

• When it is collected: when You check in to or out of a shift, and, for shifts where Your Employer has enabled geofencing, at regular intervals for the duration of the shift. This includes collection in the background, even when the Application is closed or not in use, while You are checked in to such a shift. A persistent "Location Updates" notification is displayed on Your Device whenever background location collection is active.
• When it stops: location collection stops automatically when You check out of the shift. We do not collect location data outside of an active shift, except when You open the nearby shifts map, which uses Your current location while the Application is open.
• How it is used: to verify Your attendance at the assigned work site; to record check-in and check-out locations and addresses; to confirm You remain within the site's geofence during the shift; and to show nearby available shifts on a map.
• Who it is shared with: location data is transmitted securely (encrypted in transit) to My Shift Pro servers and made available to Your Employer for attendance, safety and timesheet purposes. Maps are displayed using Google Maps. We do not sell location data and do not use it for advertising.
• Your choices: You can deny or revoke location permission at any time in Your Device settings. Some features, such as shift check-in and geofenced shifts, may not work without it.

Camera and Photos

With Your permission, the Application accesses Your Device's camera and photo library to scan QR codes at work sites, attach photos to incident reports, and set Your profile photo. Photos You choose to capture or upload are sent to My Shift Pro servers and made available to Your Employer as part of the related report or profile. We do not access Your camera or photos for any other purpose.

Push Notifications

With Your permission, the Application uses Firebase Cloud Messaging, a service provided by Google, to send You notifications about shift assignments, available shifts and other updates. A device notification token is stored on Our servers for this purpose. You can turn off notifications at any time in Your Device settings.

Usage Data

Usage Data is collected automatically when using the Service and may include Your Device's IP address, Device type, operating system version, unique Device identifiers, Application version, the time and date of use, and other diagnostic data.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

• To provide and maintain the Service, including monitoring its usage.
• To manage attendance and shifts: to record Your shift check-ins and check-outs, verify Your presence at work sites using location data, record incident reports, and provide attendance records to Your Employer.
• To manage Your Account and give You access to the Service's features.
• To contact You by email, phone, SMS or push notification about shifts, updates and security matters related to the Service.
• To manage Your requests to Us.
• To improve the Service, including data analysis and identifying usage trends.

Sharing of Your Personal Data

We may share Your personal information in the following situations:

• With Your Employer: Your profile, shift attendance, location data, QR scans, incident reports and photos are shared with the Employer that manages Your shifts.
• With Service Providers: such as hosting providers, Google (Firebase Cloud Messaging and Google Maps), to operate the Service on Our behalf.
• For business transfers: in connection with any merger, sale of Company assets, financing, or acquisition of all or part of Our business.
• For legal reasons: where required by law or valid requests by public authorities, or to protect the rights, property or safety of the Company, Our users or the public.
• With Your consent: for any other purpose with Your consent.

We do not sell Your Personal Data.

Retention of Your Personal Data

We retain Personal Data, including location and attendance records, only for as long as necessary for the purposes set out in this Privacy Policy, for as long as Your Employer requires these records for attendance and timesheet purposes, and to the extent necessary to comply with legal obligations, resolve disputes and enforce Our agreements.

Transfer of Your Personal Data

Your information may be processed at the Company's operating offices and in other places where the parties involved in processing are located, which may be outside Your state or country. We take all steps reasonably necessary to ensure Your data is treated securely and in accordance with this Privacy Policy.

Security of Your Personal Data

Data is transmitted between the Application and Our servers using encrypted connections (HTTPS). While We use commercially acceptable means to protect Your Personal Data, no method of transmission over the Internet or electronic storage is 100% secure.

Your Rights and Choices

• You can withdraw location, camera, photo and notification permissions at any time in Your Device settings.
• You can request access to, correction of, or deletion of Your Personal Data by contacting Us using the details below. Some records may need to be retained by Your Employer or by Us to meet legal obligations.

Children's Privacy

The Service is intended for workers and does not address anyone under the age of 13. We do not knowingly collect personal information from anyone under 13. If You become aware that a child has provided Us with Personal Data, please contact Us and We will remove it.

Links to Other Websites

The Service may contain links to websites not operated by Us. We have no control over and assume no responsibility for the content or privacy practices of third-party sites.

Changes to this Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated policy on this page and update the "Last updated" date above. Changes are effective when posted.
